On Your Side In IRS Tax Amnesty Cases
Although the IRS is not offering a formal tax amnesty program, IRS policy and procedures and existing tax laws and regulations may allow for the forgiveness of all or part of your tax debt. By having all or part of your tax debt forgiven, you gain freedom from the oppression of debt, freedom from the pressure of relentless collection efforts, freedom from hiding and running, and freedom to once again be a productive citizen.
How To Gain Tax Amnesty
More people are in trouble with the IRS today than ever before. That is why Massachusetts IRS tax attorney Gerard J. Levins’ 30 plus years’ experience in handling tax controversies and tax disputes and his expertise in tax law are more important than ever before.
Since the Restructuring Act was passed in 1998, the IRS adopted procedures for enforced tax collection that implement the rules under the so-called Collection Due Process Appeal rights. They were created to prevent unfettered enforcement actions before a citizen has the opportunity to present alternative solutions.
If you file a Request for Collection Due Process Hearing within the required time frame, the IRS cannot commence collection until after you have a hearing with the IRS Office of Appeals. In a Collection Due Process Appeal, the taxpayer has the right to raise “any relevant issue” as a defense to collection. These issues may include:
- Spousal defenses under code section 6015
- The appropriateness of collection action
- Potential collection alternatives, such as:
– An installment agreement
– Obtaining uncollectible status
– An Offer in Compromise
– Lien strategies
– Selective and controlled liquidation of assets or refinancing
– Removing liens that destroy credit - Challenges to the underlying tax
- The statute of limitations
- Penalties
- Misapplication of prior payments
Attorney Levins has helped hundreds of lawyers, doctors, business owners, wage earners and others with tax problems by saving them literally millions of dollars in taxes, penalties and interest. These results have been achieved by requesting Uncollectible Status, negotiating Partial Pay Installment Agreements or an Offer in Compromise. Chapter 13 bankruptcy (a wage earner’s repayment program) and Chapter 7 bankruptcy (a fresh start) have also been used successfully.
